New York didn’t ban AI compute. It banned a building.
This morning Governor Hochul signed the first statewide moratorium on hyperscale data centers in the country. Permits paused for up to a year while the state figures out rules for water, power, and everything else these facilities touch.
The industry is going to treat this like a disaster. I build data center hardware for a living and I think most of them are reading it wrong.
Here is what actually got banned: a specific building. A multi-hundred-megawatt campus that takes three to five years to entitle, drinks millions of gallons of water through evaporative cooling, hums loud enough to organize a county against it, and sits on the land forever. That building has been generating its own opposition for two years. Ypsilanti’s water utility voted to stop supplying data centers entirely. Reno extended its pause. Nye County’s water board went 5 to 0. At least 12 states have moratorium bills filed this cycle and dozens of towns beat them to it. New York is not the start of something. It is the state finally catching up to what local boards have been doing all year.
None of those laws banned compute. They banned the side effects.
Read the actual thresholds. Hochul’s order pauses permits at 50 megawatts. The stricter bill sitting on her desk draws the line at 20. Maine used 20. Other states go as high as 100. The federal proposal uses 20. Every one of these numbers was picked to catch hyperscale campuses. Which means the legal path forward in a moratorium state was written directly into the law, and almost nobody is building for it.
So let me describe the machine we designed, because it exists specifically for this moment.
It is a complete 2 megawatt AI data center. It arrives on three trucks. It is running in 15 working days on any pad that has power and fiber. It consumes zero water. Not low water. Zero, in every operating mode, on the hottest day of the year. It runs quieter than a typical county noise ordinance requires. And when the lease ends or the power gets repriced, it leaves. No permanent structure, no scar on the land, no thirty-year fight with the neighbors. The site goes back to being a site.
I am not going to explain how we got the water to zero. That is our engineering and it is patent pending. What I will say is that the industry decided decades ago that evaporating water was the cheap way to reject heat, and everything downstream of that decision, the Legionella programs, the drift, the blowdown, the millions of gallons per megawatt every year, is a choice, not physics. We made a different choice.
Here is the part that should bother people more than it does. The power exists. Utilities across the country are sitting on stranded megawatts at substations, industrial sites, and retired facilities. Interconnection is the bottleneck for new campuses, but small blocks of existing power are everywhere. The gap was never electrons. The gap is that nobody made a machine that could show up, use that power respectfully, and leave no trace. The industry kept trying to shove a cathedral through a permitting process built for a garage.
A moratorium does not pause demand. Every month New York studies the problem, the demand for inference and training capacity keeps compounding. That capacity will get built somewhere. The question every operator, utility, and town board should be asking is what form it takes. The form that triggered the backlash, or a form that never shows up on a water bill and can be gone in a week.
I think the next phase of this buildout looks less like real estate and more like equipment. Machines, not monuments. Deployed where the power already is, sized to what communities will actually accept, removable when the economics say move.
New York just paused the monuments. Good. We ship machines.
